“Ugly Bath Contest”
Official Rules
How To Enter the Contest: The Ugly Bath Contest will begin on Monday, August 9, 2010 through Friday, August 27, 2010.
To participate in this contest go online at www.waji.com and follow the directions to participate. Email a photo of your ‘ugly bath’, along with your first name and last name, date of birth, complete address, city, state, zip code, day and evening telephone number, and email address. Please, only one email entry per household. OR mail or drop off an entry to: “Ugly Bath Contest, c/o WAJI, 347 W. Berry, 6th Floor, Fort Wayne, IN 46802.
Only one email entry per e-mail address. Email entries will be deemed entered by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses.
All entries become a member of the Colvin Kitchen and Bath email database and may be contacted by a Colvin representative.
Station is not responsible for entries not received due to difficulty accessing the Internet, service outages or delays, computer difficulties or other technological glitches. All entries must be received on or before 12am on Friday, August 27, 2010.
Selection of Top Ten Entries
Beginning Friday, August 27, 2010 at 9am through Tuesday, August 31st, 2010 at 9am, a panel of judges selected by WAJI management will select up to 10 of the most appropriate ‘ugly bath’ entries and deem them the “Top 10 Ugly Baths”. All top 10 selected entries will be notified by phone before 5pm on Tuesday, August 31, 2010 and upon determination of eligibility, must agree that they are able to utilize the grand prize prior to the beginning of the voting process.
Selection of Grand Prize Winner:
On Wednesday, September 1, 2010 through Thursday, September 9, 2010 at 11:59:59pm the online judging portion of the contest will take place. Listeners will be encouraged to vote for the ‘ugliest bath’ out of the top 10 ugly baths. Only one vote per email address please.
The top 10 ugly bath finalists must be present on Saturday, September 11th, 2010 at 12:30pm at Colvin Kitchen and Bath, 1314 E. State Blvd, Fort Wayne, IN. The entry with the most votes will be revealed and deemed the grand prize winner. A proxy may be appointed if the top 10 finalist is unable to attend. Proxy information must be received no later than 5pm Friday, September 10, 2010. The proxy is merely there to represent the Top 10 finalist. The grand prize will not be awarded to the proxy but to the actual winner at a later date.
Eligibility Restrictions: You must 21 years of age or older, and be a homeowner or must have permission of the property owner to make modifications to the existing bath. You must be a legal resident in Allen, Dekalb, Noble, Whitley, Huntington, Wells, or Adams county (Indiana) to enter. Employees and interns of Colvin Kitchen & Bath, affiliated companies or of any radio station in the Fort Wayne Metro, and members of their respective families, are not eligible. Family is defined as parents, in-laws, children, spouses, people in spouse-like relationships and siblings, including those in step and half relations. Anyone who has ever been employed by or interned with Sarkes Tarzian, Inc., and members of their family, are ineligible.
Grand Prize:
A $4995 Simstone Bath from Colvin Kitchen & Bath. Prize package includes removal and disposal of following items: standard 5’ bathtub or shower, finish wall surface surrounding tub or shower base and tub/shower faucet, as well as supplying and installing new fiberglass bathtub or showerbase in white, bone or biscuit, new backerboard on tub/shower walls as needed, new Moen Brantford polished chrome Posi-Temp tub/shower faucet, SIMSTONE bath system with one recessed soap/shampoo holder and one corner shelf and a polished chrome shower curtain rod. Any changes to above prize package will be at the homeowner’s expense including repair or replacement of water-damaged subflooring, wall or floor framing or rotted plumbing waste or supply lines. Colvin will provide a one (1) year warranty against installation issues. Warranties on materials will be provided by manufacturer. Winner of grand prize must agree to all conditions or will forfeit prize.
Winner of prize and Colvin Kitchen & Bath must determine a mutually agreed upon date and time to access the house to allow measuring and verification of condition of existing tub/shower area. Installation will then be scheduled. Installation of awarded prize will take 1-2 working days to complete. The prize winner will be solely responsible for all state and federal taxes. Prize is not good towards prior purchases.
The approximate retail value of the Simstone Bath is: $4995.00
The contest Grand Prize is not transferable, and may not be substituted or redeemed for cash or any equivalent.
Conditions: Payment of all federal, state, and local taxes in connection with the award of the Grand Prize are the sole responsibility of each contest winner. Winner names will be reported on IRS Form 1099 or the equivalent, as applicable.
Each winner must agree in writing to allow their name, voice and/or likeness to be used in any advertising or broadcasting material relating to this contest for a period of one year without additional compensation.
The Grand Prize winner must sign a receipt verifying eligibility and a Liability Release, as applicable. Pursuant to the Liability Release, the winner agrees to hold WAJI, Sarkes Tarzian, Inc., and the respective officers, shareholders, directors, employees, agents and representatives of each of them harmless from and against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
These rules are subject to the interpretation of WAJI. Any aspect of these rules, including the substitution of a prize or prizes of equivalent or greater value, can be changed at the discretion of WAJI, and such changes will become effective upon on-air or other appropriate announcement. All decisions of WAJI management in the administration of this contest are final.
If all entries are deemed ineligible, the Grand Prize will not be awarded and will remain the property of Colvin Kitchen & Bath. The contest is void where prohibited.
Failure to comply with the contest rules may result in a contestant’s disqualification, at the sole discretion of WAJI.
WAJI is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcements of any prize.
WAJI also disclaims any responsibility for a qualifier’s inability to attend the Saturday, September 11, 2010 Grand Prize Event or to appoint a proxy in their place.
